Subject to these Terms, PRADO TECH YAZILIM LTD. grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Services solely for your personal, non-commercial use.

This license does not transfer ownership of the Services or any intellectual property rights.

You may not:

• copy or reproduce the Services except as permitted by applicable law;
• modify, adapt, translate, or create derivative works of the Services;
• reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Services except where expressly permitted by law;

Any rights not expressly granted under these Terms are reserved by PRADO TECH YAZILIM LTD..

Application means the mobile application known as Archythink.

Company means PRADO TECH YAZILIM LTD..

Services means the Archythink application, website, web applications, desktop applications, AI-powered design generation features, subscription services, and any related products or services provided by the Company.

User means any individual or legal entity accessing or using the Services.

Account means a registered user profile used to access certain features of the Services.

User Content means any photos, images, text prompts, files, comments, feedback, or other information submitted, uploaded, or otherwise provided by users through the Services.

Generated Content means any image, visualization, design, text, or other output created by artificial intelligence through the Services.

AI Providers means trusted third-party artificial intelligence providers used by the Company to process User Content and generate AI-powered results.

Device means any smartphone, tablet, computer, or other supported device capable of accessing the Services.

Subscription means any paid plan, recurring subscription, one-time purchase, or premium feature offered through the Services.

You must be at least thirteen (13) years of age, or the minimum legal age required in your jurisdiction, to use the Services.

If you are under the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian.

By using the Services, you represent and warrant that you satisfy these eligibility requirements.

You represent and warrant that you own, or have obtained all necessary rights, licenses, permissions, and consents to upload any photos, images, text prompts, files, or other User Content submitted through the Services.

You are solely responsible for your User Content and for ensuring that it:

• complies with all applicable laws and regulations;
• does not infringe the intellectual property rights or other rights of any third party;
• does not contain unlawful, defamatory, abusive, fraudulent, or harmful material;
• does not contain malicious software or harmful code.

You acknowledge that the Company is not responsible for User Content submitted by users.

The Company reserves the right, but is not obligated, to remove or restrict any User Content that violates these Terms or applicable law.

You retain ownership of all User Content that you upload to the Services.

By submitting User Content, you grant PRADO TECH YAZILIM LTD. a limited, worldwide, non-exclusive, royalty-free license to process, transmit, reproduce, store (where necessary), and use such User Content solely for the purposes of:

• operating the Services;
• generating AI-powered design visualizations;
• maintaining and securing the Services;
• improving the reliability and performance of the Services;
• complying with legal obligations.

Except as described in these Terms, our Privacy Policy, or as required by applicable law, we do not claim ownership of your uploaded User Content.

Archythink uses artificial intelligence to generate interior and exterior design visualizations based on User Content.

Generated Content is automatically created by AI systems and may:

• contain inaccuracies;
• include unrealistic or impractical elements;
• be incomplete;
• resemble content generated for other users;
• not always meet your expectations.

Generated Content is provided solely for inspiration, visualization, and creative purposes.

The Company does not guarantee that any Generated Content is accurate, complete, unique, feasible, safe, or suitable for any particular purpose.

The Services do not provide architectural, engineering, structural, construction, electrical, plumbing, surveying, interior design consulting, legal, financial, or other professional advice.

Generated Content should not be relied upon as a substitute for consultation with qualified professionals.

You are solely responsible for independently evaluating and verifying any Generated Content before using it for renovation, construction, purchasing, permitting, contracting, or any other real-world decision.

PRADO TECH YAZILIM LTD. shall not be responsible for any loss or damage arising from reliance on AI-generated results.

You agree not to use the Services to:

• violate any applicable law or regulation;
• upload content that infringes the intellectual property rights of others;
• upload unlawful, abusive, threatening, defamatory, hateful, discriminatory, or obscene material;
• upload viruses, malware, or other harmful code;
• interfere with the operation or security of the Services;
• attempt to gain unauthorized access to the Services or related systems;
• scrape, crawl, copy, or extract data from the Services using automated means without our prior written consent;
• reverse engineer or attempt to discover the underlying AI models or software;
• use the Services to generate unlawful, fraudulent, misleading, or harmful content;
• impersonate another person or entity;
• use the Services in any manner that could damage, disable, overburden, or impair the Services.

Violation of these restrictions may result in suspension or permanent termination of your access to the Services at our sole discretion.

We welcome your comments, ideas, suggestions, feature requests, and other feedback regarding the Services (“Feedback”).

If you voluntarily provide Feedback to PRADO TECH YAZILIM LTD., you acknowledge and agree that:

• providing Feedback is entirely voluntary;
• we are under no obligation to implement or respond to your Feedback;
• we may use, modify, reproduce, publish, distribute, or otherwise exploit such Feedback for any lawful purpose without restriction or compensation;
• Feedback does not create any confidential relationship between you and the Company.

Nothing in this section affects your ownership rights in User Content as described elsewhere in these Terms.

The Services may contain links to third-party websites, products, services, advertisements, or other online resources that are not owned or controlled by PRADO TECH YAZILIM LTD..

These third-party services operate independently from PRADO TECH YAZILIM LTD. and may be governed by their own terms and privacy policies.

We are not responsible for the availability, performance, security, or practices of third-party services.

Certain features of the Services may become unavailable if required third-party services experience interruptions or discontinue their services.

These Terms remain in effect for as long as you access or use the Services.

You may stop using the Services at any time by uninstalling the application, deleting your account (where available), and discontinuing use of the Services.

We reserve the right to suspend, restrict, or terminate your access to the Services immediately, with or without prior notice, if we reasonably believe that:

• your use of the Services may expose us or others to legal liability;
• your conduct may harm other users or the Services;

• continued access is no longer commercially or technically feasible.

Termination does not affect any rights, obligations, or liabilities that accrued before termination.

You agree to defend, indemnify, and hold harmless PRADO TECH YAZILIM LTD., its affiliates, directors, officers, employees, contractors, licensors, business partners, AI providers, and service providers from and against any claims, liabilities, damages, losses, judgments, costs, expenses, or reasonable attorneys’ fees arising out of or relating to:

• your use or misuse of the Services;
• your User Content;
• your violation of these Terms;
• your violation of applicable laws or regulations;
• your infringement of any third-party rights, including intellectual property, privacy, publicity, or contractual rights.

This indemnification obligation survives termination of these Terms.

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRADO TECH YAZILIM LTD. DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• the Services will operate without interruption or errors;
• defects will be corrected;
• the Services will always be secure;
• the Services will be available at all times;
• AI-generated results will be accurate, complete, unique, or suitable for your intended purpose;
• the Services will meet your expectations.

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRADO TECH YAZILIM LTD., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AI PROVIDERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• loss of profits;
• loss of business opportunities;
• loss of revenue;
• loss of goodwill;
• loss of data;
• interruption of business;
• personal inconvenience;
• procurement of substitute services.

This limitation applies regardless of the legal theory under which liability is asserted, whether based on contract, tort (including negligence), strict liability, statute, or otherwise.

To the fullest extent permitted by applicable law, our total cumulative liability arising out of or relating to the Services shall not exceed the greater of:

• the total amount you paid to PRADO TECH YAZILIM LTD. for the Services during the twelve (12) months immediately preceding the event giving rise to the claim; or
• one hundred United States Dollars (USD $100), where no payment has been made directly toPRADO TECH YAZILIM LTD..

Nothing in these Terms limits liability that cannot legally be excluded under applicable law.

If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

Any invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it enforceable while preserving its original intent.

No failure or delay by PRADO TECH YAZILIM LTD. in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right.

Any waiver shall be effective only if made in writing and signed by an authorized representative of the Company.

A waiver of any breach shall not constitute a waiver of any subsequent breach.

These Terms, together with our Privacy Policy and any additional policies or legal notices incorporated by reference, constitute the entire agreement between you and PRADO TECH YAZILIM LTD.regarding the Services.

These Terms supersede all prior or contemporaneous agreements, communications, understandings, and representations relating to the Services.

Certain features of the Services may require payment or an active subscription.

Purchases and subscriptions may be offered through the Apple App Store, Google Play, our website, or other authorized platforms.

Prices, available subscription plans, billing periods, and features may vary depending on your country, platform, promotional offers, or applicable taxes.

Subscriptions automatically renew unless canceled before the renewal date through the platform on which the subscription was purchased.

Cancellation prevents future renewals but does not automatically entitle you to a refund for payments already made.

Purchases made through Apple App Store, Google Play, or another third-party platform are subject to that platform’s payment, cancellation, and refund policies.

If purchases are made directly through our website in the future, they will be governed by the payment terms and refund policy published on the applicable website.

We reserve the right to change subscription plans, pricing, promotional offers, or available features at any time, subject to applicable law and platform requirements.

The Services, including but not limited to:

• the Archythink application;
• software;
• source code;
• object code;
• algorithms;
• user interfaces;
• graphics;
• logos;
• trademarks;
• service marks;
• designs;
• databases;
• documentation;
• text;
• audiovisual content;
• branding;
• technology;

and all related intellectual property rights are owned by or licensed to PRADO TECH YAZILIM LTD. and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

Except as expressly permitted by these Terms, no part of the Services may be copied, reproduced, modified, distributed, publicly displayed, sold, licensed, or otherwise exploited without our prior written consent.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

We encourage users to contact us first in an effort to resolve any dispute informally.

Most concerns can be resolved quickly by contacting our support team.

If a dispute cannot be resolved informally, either party may pursue any remedies available under applicable law.

Nothing in this section limits any consumer rights that cannot be waived under applicable law.

Before initiating formal legal proceedings, you agree to provide written notice describing the nature of your dispute and the relief sought.

PRADO TECH YAZILIM LTD. will make reasonable efforts to resolve the dispute in good faith within a reasonable period after receiving such notice.

Nothing in this provision prevents either party from seeking urgent injunctive relief where permitted by law.

These Terms and any dispute arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles.

Subject to any mandatory consumer protection laws applicable in your jurisdiction, the competent courts and enforcement offices located in Türkiye shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Services.

If mandatory laws in your country of residence provide you with additional legal rights, nothing in these Terms shall limit those rights.

If you voluntarily submit ideas, proposals, concepts, designs, suggestions, business plans, creative works, or other materials that are not specifically requested by PRADO TECH YAZILIM LTD., you acknowledge and agree that:

• such submissions are provided voluntarily;
• no confidential relationship is created;
• we are under no obligation to review or use them;
• we may use, modify, reproduce, publish, commercialize, or otherwise exploit such submissions without restriction or compensation, unless prohibited by applicable law.

Archythink uses artificial intelligence technologies provided by trusted third-party AI providers to generate interior and exterior design visualizations based on User Content.

Generated Content is created automatically using artificial intelligence and may contain inaccuracies, unrealistic elements, incomplete information, or content that resembles designs generated for other users.

The Services are intended solely for visualization, inspiration, and creative exploration.

Generated Content should not be relied upon as professional architectural, engineering, structural, construction, electrical, plumbing, legal, financial, safety, or other professional advice.

You are solely responsible for reviewing, evaluating, and verifying all Generated Content before using it for renovation, construction, purchasing, permitting, contracting, manufacturing, or any other real-world purpose.

PRADO TECH YAZILIM LTD. makes no representation or warranty regarding the feasibility, legality, safety, suitability, originality, or accuracy of AI-generated content.

You may stop using the Services at any time.

Where account deletion functionality is available, you may request deletion of your account through the Services or by contacting us.

Deleting your account may permanently remove your account information and certain associated data, subject to our Privacy Policy and any legal obligations requiring us to retain specific information.

Some information may be retained where required by applicable law, to resolve disputes, enforce our agreements, prevent fraud, or protect the security and integrity of the Services.

Deletion of your account does not automatically cancel active subscriptions. Subscription cancellation must be completed through the platform on which the subscription was purchased.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by applicable law, PRADO TECH YAZILIM LTD. disclaims all warranties and representations, whether express, implied, statutory, or otherwise.

Without limiting the foregoing, we do not warrant that:

• the Services will always be available;
• the Services will operate without interruption;
• errors or defects will always be corrected;
• the Services will be secure or free from harmful components;
• Generated Content will meet your expectations;
• Generated Content will always be accurate, complete, unique, lawful, or suitable for any particular purpose.

Your use of the Services is entirely at your own risk.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, process, store, disclose, transfer, and protect your personal information.

By accessing or using the Services, you acknowledge that you have read, understood, and accepted our Privacy Policy.

If there is any conflict between these Terms and the Privacy Policy regarding the processing of personal data, the Privacy Policy shall govern to the extent of that conflict.
